Forget It Jake, It's Baltimore

Jazz Shaw at Hat Hair, Feds Plan to Ask to Seize Marilyn Mosby's Florida Condo

Democrats have been working overtime in New York in an effort to seize Donald Trump's commercial and private property, including his estate at Mar-a-Lago. Thus far those efforts have come up short, but they may have inadvertently given others some ideas that could come back to bite one of their own. In Baltimore, former State's Attorney Marilyn Mosby is facing sentencing on a variety of charges ranging from perjury to fraud, including the fraudulent use of pandemic relief funds to buy luxury real estate holdings in Florida. On Friday, federal prosecutors in the case filed a motion asking the court to allow them to seize one of Mosby's vacation condos there as partial payment for the fines she will be expected to pay. Oh, how the mighty have fallen. (Baltimore Sun)
Federal prosecutors filed notice Friday that they will ask to seize former Baltimore State’s Attorney Marilyn Mosby’s Florida vacation condo on the same day as her sentencing on perjury and mortgage fraud charges.

The government indicated early on in the case that it would seek forfeiture. Friday’s filing formalizes prosecutors’ request and sets up the possibility of a legal fight over the condo at Mosby’s May 23 sentencing.

The government intends to sell the condo, according to the motion, which Mosby bought in February 2021 for $476,000. If there are profits from the sale, Mosby would get back her $47,600 down payment, prosecutors wrote.
As we previously discussed, Mosby has publicly called on Joe Biden to issue her a pardon so she can avoid all of this trouble. Unfortunately for her, Biden appears to have more than enough problems on his own plate at the moment. Overriding a series of lawful convictions in a case of official corruption and fraud probably wouldn't do much for his already plummeting poll numbers. In past cases of officials being prosecuted and receiving stiff financial penalties, the debt has typically followed them around once they were released from prison. That was the case with Rod Blagojevich, one of four of the past ten Illinois governors who wound up going to jail. He was hit with some hefty fines, but the court didn't wind up taking his property.

Perhaps we'll be seeing more of this in the future, however. This happens more often than some might think. There are three types of asset forfeiture available to the courts. These are described as criminal forfeiture, civil judicial forfeiture, and administrative forfeiture. Mosby would be facing criminal forfeiture, while Donald Trump is being threatened with civil judicial forfeiture in the hush money case. The courts are able to either seize the title to your property or order banks and other financial institutions to place a hold on your financial assets so you are unable to access them.

I suppose an action like this could send a message to other public officials and would likely be seen as justice being served in Mosby's case. But it still doesn't address the more important, underlying question. How is it that we keep ending up with public officials who violate the trust of the voters and seek to line their own pockets illegally? This is particularly problematic in Baltimore, where a series of mayors and City Council members have wound up in handcuffs. We are currently only a couple of weeks away from the city's mayoral primary, which winds up being effectively the same as the general election. The latest polling shows that former Mayor Sheila Dixon is running neck-and-neck in her bid to return to office.

This is the same Sheila Dixon who was driven from office and only barely avoided prison time after being convicted of fraud, theft, and criminal misappropriation. (She was sentenced to four years probation in a sweetheart plea deal.) And now the voters of Baltimore appear to be poised to potentially put her back in office. There is the answer to the question above. We keep winding up with politicians going on trial for criminal activity because we keep electing the same pack of criminals over and over again. Who is really to blame here... the politicians or the voters?

It's too bad she was caught too early to get in on the Trump feeding frenzy. I'm sure she could have found an excuse to bring him to trial. Then she'd likely have been off limits to Federal prosecutors.

Campus Reform reports Humboldt campus occupiers left 8,000 LBS of debris, university says "A spokeswoman from California State Polytechnic University, Humboldt told Campus Reform that the anti-Israel campus occupiers left 8,000 lbs in debris for workers to clean up."

A spokeswoman from California State Polytechnic University, Humboldt told Campus Reform that the anti-Israel campus occupiers left 8,000 lbs in debris for workers to clean up.

Protesters at Cal Poly Humboldt previously occupied a portion of campus and two buildings, naming one of the “intifada hall.”

Posts on social media show that the protesters have vandalized a building on campus with anti-Israel messaging. The university estimates damage to property is in the millions, according to a university.

”Blood on your hands,” one message inside a campus office states.
. . .
The spokeswoman said that 32 campus occupiers were arrested on early Tuesday morning, adding that 13 were students, 1 is a faculty member, and 18 were non-students.

While the university told Campus Reform that damage to campus is in the millions, the spokeswoman said that an exact cost will be released shortly.

Roz Rothstein, co-founder and CEO StandWithUs, an international nonpartisan education organization that supports Israel and fights antisemitism, told Campus Reform that Cal Poly Humboldt should have intervened much earlier.

”While we stand with Humboldt’s decision to enforce both state law and its own campus policies, it’s clear that earlier intervention with this ‘encampment’ could have averted much of this chaos,” said Rothstein. “It is important that administrators nationwide take note and commit to enforcing their own policies on an ongoing basis instead of waiting for things to escalate.”

I guess they had to do something since there's no longer a statue of William McKinley in the Arcata Town Square to march around and climb on.

Flotsam and Jetsam - Jack Smith Admits to Tampering Classified Documents

John Solomon at JTN writes of a Trump Whodunnit: Prosecutors admit key evidence in document case has been tampered with "Legal experts call revelation a “serious violation” as Jack Smith’s team admits it also misled court."

In a stunning admission, Special Counsel Jack Smith’s team is admitting that key evidence in former President Donald Trump’s classified documents criminal case was altered or manipulated since it was seized by the FBI, and that prosecutors misled the court about it for a period of time. . . .In a new filing Friday, Smith’s team said that the order of documents in some of the boxes of memos that were seized by the FBI from Trump’s Mar-a-Lago estate was altered or jumbled, leaving two different chronologies: one that was digitally scanned and another the physical order in the boxes.

Smith’s team in a footnote also conceded it had misled the court about the problem by previously declaring that the evidence had remained in the exact state it had been seized. “The Government acknowledges that this is inconsistent with what Government counsel previously understood and represented to the Court,” the footnote said.

PM, Jack Smith admits that evidence in Trump’s classified documents Mar-a-Lago case was tampered with. “The Government acknowledges that this is inconsistent with what Government counsel previously understood and represented to the Court.” Althouse cite Politico"Special counsel Jack Smith’s team acknowledged Friday that some evidence in the prosecution of former President Donald Trump for hoarding classified documents at his Florida home...". I don't know how big a problem this is for the prosecution. Certainly, chain of custody on evidence is very important, and this suggests the evidence was handled sloppily by the Smith team. In a worst case, Judge Cannon could thrown out the evidence as tainted. With the team staffed with anti-Trumper, there's a possibility that a "smoking gun" could have been inserted later. But I'm going to bet against it.

Oregon, My Oregon

From John Sexton at Hat Hair, Arsonist Attacks Portland Police Vehicles

When Portland police arrived at a department training facility to help with a fire on Thursday morning, they found at least 15 patrol vehicles burning.

The Portland Police Bureau is searching for a suspected arsonist who they believe set the cop cars on fire around 1:55 a.m. while the vehicles were parked in a fenced training area, the department said in a news release.
The PPB released several photos of the burned cars, including this one.
The investigation is underway but the arsonist was caught on video so there's no question what happened here. The question that does remain is who is responsible. Everyone seems to know the answer even if they aren't saying it outright. Portland anarchists have had quite a week. Wednesday, just prior to the arson, a group walked through the city breaking windows.
Fireworks were set off, windows were broken and property was spray-painted by a group of suspects marching through downtown Portland Wednesday, according to Portland Police Bureau...

Police said among the businesses damaged include banks, coffee shops, cell phone and electronic stores, retail clothing and accessories shops and property belonging to Portland State University.
As mentioned, there was also a lot of damage done to the library at Portland State University. Are all of these things connected? There's no proof of that so far but what we can say is that the same sort of masked anarchists who smash windows and start fires also may have been involved at PSU. The police released a list of everyone they arrested yesterday when they cleared out the campus library and very few of these people strike me as the usual undergrads.
